Terms of Service

Effective August 24, 2026.

1. What TopStay is

TopStay.lol is a public leaderboard. Position is determined entirely by the total amount paid against a listing, resolved by highest total first and, for equal totals, by whoever reached that total earliest. It is paid placement. It is not a review, rating, award, ranking of quality, endorsement, certification, or recommendation of any property, and no listing should be presented to consumers as such.

We are not a travel agency, booking platform, or intermediary. We do not take reservations, hold funds for stays, or become party to anything that happens between a guest and a property.

2. Eligibility and authority

• You must be at least 18 and able to enter a binding contract.
• You confirm you own the property or are authorized by the owner or operator to list it and to spend the funds you are spending.
• You confirm the URL, name, photo, description, and location are accurate, current, and yours to use.
• There are no accounts. Whoever controls the submitted URL controls the listing.

3. Bids, pricing, and rank

• A bid is a payment for placement, not a deposit, not an investment, and not a purchase of advertising inventory for a fixed duration.
• Bidding is cumulative per property URL. Raising an existing listing charges only the difference between your new total and the current total.
• The minimum for a new listing is $5. All prices are in US dollars.
• Rank is claimed when the payment completes, and it holds only until someone pays more.
• All payments are final and non-refundable, including when your listing is immediately outranked, when the board changes, or when you change your mind.
• We make no guarantee of bookings, traffic, clicks, revenue, conversion, impressions, uptime, or time spent at any rank.
• You are responsible for any taxes applicable to you. Card details are handled by our payment processor and never reach our servers.
• Chargebacks or payment reversals initiated after placement was delivered are a breach of these terms; we may remove the listing and refuse future bids.

4. Prohibited listings and content

Do not submit, and do not link to, any of the following:

• Anything unlawful in the property's jurisdiction, or a property that lacks required permits or licenses to host guests.
• Adult or sexual services, escort services, or any listing whose actual offering is sexual in nature.
• Gambling, unregulated financial or crypto offers, MLM or recruitment schemes, loans, or get-rich content dressed up as a stay.
• Listings that discriminate against or exclude guests on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or family status.
• Hate speech, harassment, threats, violent or extremist material, and content that sexualizes minors in any way.
• Malware, phishing, deceptive downloads, cloaked or redirecting URLs, link shorteners, affiliate wrappers, or destinations that differ from the page we fetch.
• Fake, unbuilt, unavailable, or misrepresented properties; addresses or amenities that do not exist; fabricated star ratings or review counts.
• Photos, copy, floor plans, or video you do not own or have no license to use, including images scraped from other listings.
• Another company's name, brand, logo, or trademark used in a way that implies affiliation you do not have.
• Personal information about anyone else, doxxing, or private contact details presented as property info.
• Non-lodging commercial links: SaaS products, courses, marketing agencies, general e-commerce, or anything that is not a place to stay.
• Spam behavior: duplicate listings for the same property under different URLs, near identical submissions, keyword stuffing in the name field, or many listings created to occupy multiple ranks.
• Automated, scripted, or bot bidding; attempts to manipulate displayed totals, click counts, or visit counts; scraping, rate-flooding, or probing the site or its APIs.

5. Moderation

We may, at our discretion and without notice, edit a listing's name or description, recategorize its stay type, correct or remove its location or photo, hide it, or remove it entirely if it breaks these terms, breaks the Rules, or breaks applicable law. Removal for a violation does not entitle you to a refund. Repeat or egregious abuse can result in a permanent ban on future submissions.

We also may remove or decline listings for reasons of legality, payment risk, or basic reputation of the board, even where no specific rule above is cited.

6. Third-party sites and automated metadata

Listings link to sites we do not control, and we make no warranty about them. To reduce data entry, we automatically fetch the public page at the URL you submit and may read its title, description, image, location, and any published rating. By submitting a URL you authorize that fetch and grant us permission to display what we retrieve. Any star rating shown is reproduced from the property's own public page, is unverified, and may be outdated.

7. License to your content

You grant Beloved Ventures LLC a worldwide, royalty-free, non-exclusive license to host, display, resize, and excerpt the submitted name, description, photo, location, and URL on the site and in related promotion of the board, for as long as the listing or its public bid record exists.

8. Copyright complaints

If you believe content on TopStay.lol infringes your copyright, contact @heisnathan with the URL of the listing, identification of the work, your contact details, a statement of good-faith belief that the use is unauthorized, and a statement that your notice is accurate. We remove infringing content on valid notice and terminate repeat infringers.

9. Disclaimers and limits

The site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Beloved Ventures LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost bookings, lost data, or loss of goodwill. Our total aggregate liability for any claim is limited to the amount you paid us in the thirty days before the claim arose.

You agree to indemnify and hold harmless Beloved Ventures LLC and its founder from claims, damages, and costs arising out of your listing, your content, your use of the site, or your breach of these terms.

10. Governing law and disputes

These terms are governed by the laws of the State of Oregon, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Oregon, and you consent to that jurisdiction and venue. Claims must be brought within one year of the event giving rise to them, individually and not as part of a class action.
